Terms of Use for the delivery of newsletters

1 Subject
These Terms of Use govern the general legal framework between you and the Swiss National Accident Insurance Fund (Suva, Fluhmattstrasse 1, CH-6004 Lucerne, hereinafter: “Suva”) for the delivery of the newsletter and the use of its content. Suva sends out a newsletter under the following Terms of Use and is responsible for data processing in the context of the newsletter.
2 Commencement of the agreement
In order to receive the newsletter, you must first agree to the Terms of Use. To do this, click on the relevant checkbox when registering for the newsletter.
3 Data and use of data
By entering the data listed below, you give your consent for Suva to use your details for the purposes of delivering newsletters. So that Suva can provide a personalised version of the newsletter with content relevant to you, the following data pertaining to you is processed:
- Gender, first name, surname: for a personal address in the newsletter
- E-mail address: to deliver the newsletter
- Language: to provide the content in your chosen language
- Interests/preferences: to select relevant topics and personalise the content of the newsletter
This data is processed exclusively for the purposes of personalised and needs-based communication via newsletter. Suva may also instruct service providers to process the above-mentioned data for these purposes on its behalf. Suva concludes suitable contractual agreements with service providers to protect your data. Data is not forwarded to third parties or used for any other purposes.
4 Deletion
Both you and Suva may terminate this agreement at any time, on your part by unsubscribing from the newsletter, and on Suva’s part by ceasing delivery of the newsletter.
By unsubscribing from the newsletter, your e-mail address will be removed from the mailing list for the newsletter in question. Unless you are subscribed to another Suva newsletter, all your remaining details will be permanently deleted after one year.
If you are subscribed to other Suva newsletters, your data will remain stored for as long as is required to deliver the other newsletters or as long as you have not unsubscribed from all newsletters.
You may request the deletion of all your data in connection with the newsletter, the definitive deletion of your data before one year has passed as stipulated above as well as the cancellation of all newsletter subscriptions and the immediate deletion of all your details. To do this, simply send an e-mail to webtracking@suva.ch.
Suva reserves the right to restrict access to your data for the newsletter without prior notification and to delete your data, particularly in the case of suspected misuse.
5 Data protection
Suva uses every appropriate technical and organisational measure at its disposal to protect your data from unauthorised access or unlawful data processing.
Suva uses data collected in connection with newsletter registration exclusively within the scope of these Terms of Use and the Privacy Notice.
By subscribing to newsletters, you authorise Suva to record and store all registration data such as gender, first name, surname, e-mail address, language and any interests and to process this data in line with the data protection policy and for the purposes of further developing applications. The data protection policy also provides options for rejecting data processing.
You have the right to receive information at any time about what data Suva holds and processes about you. If your data is incomplete or incorrect, you may request addition or rectification. You may object to the processing of your data and request its deletion under the legal and contractual provisions.

6 Warranty and liability
Suva shall keep the newsletter up to date with the latest technology. Users cannot make any claims regarding warranty. Suva’s liability for damage in connection with the use of the newsletter or the information contained therein is limited to cases of gross negligence and intentional misconduct. Any further liability is expressly excluded. Liability is also completely excluded in cases involving Suva auxiliary staff.
Suva does not guarantee the accuracy, completeness or up-to-date nature of the content provided. To the extent permitted by law, Suva disclaims all liability for
- direct and indirect damage resulting from transmission errors,
- technical defects and/or failures,
- disruptions, network overload and/or unlawful interference or access by third parties,
- failure to recognise lack of legitimacy,
- careless use of personal authentication features,
- deletion of access or data, lack of security and/or functionality of the hardware and software used by the users
or for other reasons connected with the use of the newsletter or the use of the information contained therein.
The newsletter may contain links to external sources. Suva accepts no responsibility for the content or use of these links. Furthermore, you connect to these websites at your own risk.
7 Legal provisions of the Suva website
The legal provisions of the Suva website also apply here mutatis mutandis.
8 Changes to the Terms of Use
Suva reserves the right to unilaterally amend the newsletter Terms of Use at any time. The current version published on our website at any given time applies. You will be informed of any changes to the Terms of Use electronically or via another suitable channel.
Upon first receipt of the newsletter after the changes, you accept the amended Terms of Use without reservation. Your objection to the amendment of the Terms of Use shall be deemed termination of the agreement and will be accepted as cancellation of your subscription to the newsletter (see section 4).
Suva reserves the right to adapt the content of the newsletter, to modify the scope of services at any time and/or to adapt these services in line with legal or technical developments.
9 Place of jurisdiction and applicable law
The exclusive place of jurisdiction is Lucerne, subject to any statutory places of jurisdiction. This agreement is subject exclusively to Swiss law.
